Erin E. Wietecha Secures Victory for Homeowner in the Supreme Court of the United States
On October 6, 2025, the Supreme Court of the United States denied certiorari in U.S. Bank N.A. as Trustee v. Fox, No. 24-1178, in which Erin secured a dismissal of a residential mortgage foreclosure action. US Bank, along with three separate banking associations, had asked the Supreme Court to take up the case. Erin filed a brief in opposition with the Supreme Court in August 2025. The denial of certiorari means that the New York Supreme Court’s decision dismissing the complaint as time-barred is final, and the mortgage is no longer enforceable.
